The Royal Decree 773/1997 of May 30, 1997 determines, within the framework of the Occupational Risk Prevention Law 31/1995 of November 8, 1995, the minimum health and safety provisions for the selection, use by workers at work and maintenance of personal protective equipment.Article 3 stipulates that the employer is obliged to provide workers with personal protective equipment free of charge and to replace it when necessary.The employer shall ensure the correct use, making sure that the personal protective equipment is properly used and maintained, and the worker is obliged to correctly use and care of the equipment supplied by the employer, as well as to report any defect, anomaly or damage that may affect the equipment and compromise its protective effectiveness.Now that we have determined the obligations regarding Personal Protective Equipment by the employer and worker, how can we justify that they are carried out?
How can we ensure that these obligations are fullfilled?
The activity related to personal protective equipment is determined and included in the Occupational Risk Prevention Plan in the form of a control procedure and methodology. The company must have a plan that includes how and in what form personal protective equipment is provided to workers.In order to be able to justify that the above points have been fulfilled, there must be a proof of delivery of Personal Protective Equipment duly completed and signed by the company and the worker. These records and the proper control of this equipment are the basis of good health and safety management of workers.
What information should these records contain?
PPE delivery records shall contain the essential information that proves the correct management and delivery of the PPE.• Worker's data
• Work area and position occupied
• Identification of the personal protective equipment that is being handed over to him/her
• Date of delivery
• Signature of the worker and of the person responsible for the deliveryThe document shall state the worker's acknowledgement of having received the instructions for use, as well as his commitment to use and care.
